The 10% cap is the defining market rule
Public Act 286 limits alternative-supplier participation, and utilities use cap-tracking or queue procedures when demand exceeds available room. The Michigan Public Service Commission’s 2025 Electric Competition Status Report, published in February 2026, said the choice programs for Consumers Energy, Upper Michigan Energy Resources, Upper Peninsula Power, Indiana Michigan Power, and DTE Electric were fully subscribed at the cap during the year, with DTE just below the numeric limit because the next queued account was too large to fit.
